When purchasing an EMR, getting legal requirements right is critical. You can bet that the EMR developers purchasing or licensing agreement favors the developer more than the physician. You will find help in the book, "How to Evaluate Electronic Health Record (EHR) Systems", By Patricia A. Trites, MPA, and Reed D. Gelzer, MD, MPH, that is available from AHIMA. Dr. Gelzer"s book ($129) but covers the topic in some detail. Also see the new book on HIPAA: "HIPAA Plain & Simple - Updated 2010", By Carolyn Hartley, available from AMA in April 2010. We suggest physicians budget anywhere from $5K to $10K for legal assistance for contract and purchase negotiations depending on how complex a system you specify.
